Privacy Policy

Pacify Technologies, LLC (“Pacify”, “us”, “we”, or “our”) operates mobile applications (“Apps”) and websites. This Privacy Policy applies to all Pacify Apps and websites (collectively, the “Services”).

We collect and use your personal data in order to provide our Services to you, to improve our Services, and to inform you about updates to our Services. Our goal is to make our Services as simple to use as possible while protecting your data. We also provide your data to third-party service providers, including payment providers, to allow us to provide certain services to you. Our Services may also integrate with the application program interface (API) of third-party service providers to limit the data stored on our servers. This Privacy Policy (“Policy”) describes how we collect, use, and disclose your personal data when you use our Services and the choices you have associated with that data. Please review this Policy carefully.

By using our Services, you agree to the collection and use of information in accordance with this Policy. Unless otherwise defined in this Policy, the terms used in this Policy have the same meanings as in our Terms of Service.

Types of Data We Collect

Personal Data Provided by You

While using our Services, we or a third-party service provider may ask you to provide certain personally identifiable information that can be used to open or update an account for you, contact you, or to identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

  • First name and last name
  • Email address
  • Phone number
  • Login name and password
  • Address
  • Credit card or banking information
  • Social security number (Snow Pacifier individuals only)
  • Employer Identification Number (EIN) (Snow Pacifier companies only)
  • Driver license number (Snow Pacifier individuals operating plows only)
  • Insurance information (Snow Pacifiers operating plows only)
  • Birth date (Snow Pacifiers only)
  • Photo (Snow Pacifiers only)
  • Signature
  • Your preferences or settings

Data From Other Sources

We may also receive the following information about you from other sources if applicable:

Background check data such as:

  • Your social security number trace information (Snow Pacifier individuals only)
  • Criminal records information (Snow Pacifier individuals only)
  • Motor vehicle records information (Snow Pacifier individuals operating plows only)
  • Employer identification number validation (Snow Pacifier companies only)

Usage Data

We may also collect certain information automatically whenever you visit our Services or access the Services through a mobile device or when we send a marketing email to you (“Usage Data”).

This Usage Data may include information such as the device you use to access our Services, operating system, Internet Protocol address (e.g. IP address), browser type and version, email client type, and other diagnostic data.

We also collect details related to your use of our Services, including but not limited to, when a service was requested, when a service was completed, the location of provided services, details of a service, time spent to complete a service, payment amounts associated with a service, distance traveled to perform a service, acceptances, cancellations, number of services completed, chat communications between Users and Pacifiers, ratings, and comments.

We automatically share information about you and requested services with other parties who help to facilitate the services, such as Snow Pacifiers and payment providers.

Location Data

For safety and service optimization, Snow Pacifiers (providers) may be required to enable location services while providing, or showing availability to provide, snow removal services. Jobs are offered to Snow Pacifiers based on different factors, including real-time location. We do not use or store location information of Users who request snow removal services on the platform.

Tracking Data

Pacify does not currently use cookies. But third-party services incorporated into our Services may use cookies and similar tracking technologies to collect certain information and to personalize your experience with our Services. Cookies are files with a small amount of data that are sent to your browser from a website and stored on your device. Third-party services may use cookies to make the use of our Services easier by remembering your preferences or default options. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.

The marketing and service emails we send through Mailchimp use web beacons. These web beacons track whether the email sent through the service was delivered and opened and whether links within the email were clicked. This information is used to measure and improve the effectiveness of our emails.

Use of Data

Pacify may use the collected data for various purposes including, but not limited to:

  • Perform background checks by third-party vendor (Snow Pacifiers only)
  • Verify your identity and eligibility to use our Services
  • Create your account and grant access to the platform
  • Send newsletters and other promotional information and track their effectiveness
  • Provide service and track the progress of your service
  • To understand who is requesting services for you or on your behalf
  • Enable features to personalize your account, such as defaulting your favorite options
  • To notify you about changes and updates to our Services
  • Process or facilitate payments for services and provide payment histories
  • Set up direct deposit and issue payments to you (Snow Pacifiers only)
  • Assess supply, demand, and other factors associated with our Services
  • Monitor and analyze usage within Services
  • Conduct data analysis and testing to improve our Services
  • Manage our everyday business needs such as complying with the law
  • To detect, address, and prevent technical issues
  • Maintain the safety, security, and integrity of our users and Services
  • Identify and prevent detrimental behavior on the platform
  • Improve the content and functionality of the Services
  • Improve service by providing feedback (such as ratings or comments to Snow Pacifiers)
  • Respond to your questions and assist with any problems
  • Resolve claims or disputes
  • Provide transactional emails

Pacify uses the services of Mailchimp for our email marketing. Their privacy policy may be viewed at mailchimp.com/legal/privacy. By creating an Account on our Services, you agree to subscribe to newsletters and other promotional information we may send via email. However, you may opt out of receiving these communications by following the instructions provided in the email or by contacting us. You may not, however, unsubscribe from non-marketing communications or communications related to services initiated by you as a User or Snow Pacifier (provider). We provide status notifications, updates, and receipts related to your account. These notifications are a necessary part of using the Services, and cannot be disabled. However, you may be able to adjust the method by which you receive these notifications.

Pacify uses the services of Zoho Desk to provide you better customer service and support. The privacy policy for Zoho may be viewed at zoho.com/privacy. Your written and verbal communications may be directed to the Zoho platform, where our support team will review and address your inquiries. To help us protect your personal information, we recommend that you avoid submitting sensitive information.

Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers and servers located outside of Pacify and outside your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. This includes the servers of third-party cloud storage providers. Your submission of such information represents your agreement to that transfer. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

Pacify will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy, and transfers of your Personal Data are to organizations and countries with adequate controls in place, including in regards to the security of your data and other personal information.

Disclosure of Data

Business Transaction

If Pacify is involved in or negotiating a merger, acquisition or asset sale, your Personal Data may be transferred to one or more third parties as part of that transaction.

When Required by Law

Under certain circumstances, Pacify may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Pacify may also disclose your Personal Data if it believes in good faith that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of Pacify Technologies, LLC
  • To prevent or investigate possible wrongdoing in connection with the Services
  • To protect the personal safety and property of users of the Services or the public
  • To protect against legal liability

Third Parties and Pacifiers

To promote the quality of our Services, we may share your information, including contact information and Personal Data, with third parties that provide services to us. The third parties are expected to provide the same level of protection of your information as we do, in accordance with this Policy. This may include information provided by you or information automatically collected through our Services. The information may be shared directly or through an API or service that integrates with our Services to deliver a service to you.  Third-party service providers may include, but are not limited to:

  • Payment processors
  • Background-check providers (Snow Pacifiers only)
  • Cloud storage providers
  • IT and data security vendors
  • Professional service providers such as lawyers and accountants
  • Customer support consultants
  • Data processing and analytics vendors
  • Help desk software providers
  • Email and phone service providers
  • Email marketing and communications vendors
  • Transactional email providers

We may also share your information, including your ratings and comments, with the Snow Pacifiers responsible for providing snow removal services to you. These third parties and Snow Pacifiers have access to your Personal Data only to perform specific tasks on our behalf and are obligated not to disclose or use it for any other purpose. We will treat certain of your communications, including questions, suggestions, or concerns that do not pertain to your Personal Data, as non-confidential and non-proprietary.

Payments

We use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their privacy policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. Our Services may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third-party’s site. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Children’s Privacy

Our Services are not intended for children under the age of 14, and we do not knowingly collect personally identifiable information from anyone under the age of 14. We also do not knowingly collect personally identifiable information from children ages 14 to 17 without parental consent. If we become aware that we have collected Personal Data from children under the age of 14 or from children ages 14 to 17 without verification of parental consent, we will take steps to remove that information from our servers. If you are a parent or guardian and you are aware that your child has provided us with Personal Data outside these limits, please contact us at support@pacifysnow.com. To help us protect your child’s personal information, we recommend that you don’t include any sensitive information in the email.

Security of Data

The security of your data is important to us but remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. Please keep this in mind when disclosing any Personal Data or other information to Pacify. You are responsible for safeguarding your username and password.

Data Retention

You may request to delete your account from our services at any time by emailing us at support@pacifysnow.com. To help us protect your personal information, we recommend that you don’t include any sensitive information in the email. We may temporarily retain personal information about you even after we delete your account from our Services, as our servers may retain backup copies of such information. We may also retain records relating to your past purchases for financial reporting and compliance purposes. We may retain and use your personal information as necessary to meet our legal obligations, resolve disputes, enforce our agreements, or for legitimate business purposes, such as fraud prevention and promoting the safety and security of our platform.  We may retain non-personal data or aggregated data indefinitely.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any change by posting the new Privacy Policy on this page. If there are significant changes to the way we use or disclose your personal information, we will let you know via email or a prominent notice on our Services, and will also update the ‘Effective Date’ at the top of this Privacy Policy.  If you object to any of the changes, you should cease using our Services. Your continued use of our Services after any change to this Privacy Policy indicates your consent to the revised Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
